GENERAL TERMS ANS CONDITIONS OF SALE
In accordance with Article R.211-14 of the French Tourism Code, brochures and travel contracts offered by travel agents to their clients must include in full the general terms and conditions derived from Articles R211-5 to R211-13 of the Tourism Code.
According to Articles L211-8 and L211-18 of the Tourism Code, the provisions of Articles R211-5 to R211-13 of the Tourism Code, reproduced below, do not apply to the booking or sale of transport tickets not included within a travel package.
The brochure, quotation, proposal, or organizer’s program constitutes the prior information referred to in Article R211-7 of the Tourism Code. Therefore, unless otherwise stated on the front of this document, the characteristics, special conditions, and prices of the trip as indicated in the brochure, quotation, or organizer’s proposal are contractual upon signing the registration form.

Article R.211-5
The prior information provided to the consumer binds the seller, unless the seller has expressly reserved the right to modify certain elements. In this case, the seller must clearly indicate the extent and nature of possible modifications. Any changes to prior information must be communicated to the consumer before the contract is concluded.
Article R.211-6
The contract between the seller and the buyer must be written, in duplicate, with one copy provided to the buyer, and signed by both parties. For contracts concluded electronically, Articles 1369-1 to 1369-11 of the French Civil Code apply. The contract must include the following clauses:
1° Name and address of the seller, guarantor, insurer, and organizer;
2° Destination(s) of the trip and, if split, the periods and dates;
3° Means, characteristics, and categories of transport, including departure and return dates and locations;
4° Accommodation type, location, comfort level, main characteristics, and tourism classification according to local regulations;
5° Catering services offered;
6° Itinerary for tours;
7° Visits, excursions, or other services included in the total trip price;
8° Total price of services and any potential price revisions per Article R.211-8;
9° Any applicable taxes or fees, such as airport, boarding, landing, or tourist taxes, if not included;
10° Payment schedule, with the final installment no less than 30% of the total price, payable upon delivery of travel documents;
11° Any special conditions requested by the buyer and accepted by the seller;
12° Procedures for filing complaints regarding non-performance or poor performance of the contract;
13° Deadline for informing the buyer in case of trip cancellation due to insufficient participants;
14° Deadline for notifying the seller if the contract is transferred;
15°Commitment to provide, at least ten days before departure, local contact details and, for minors traveling abroad, a direct contact number;
20° - 21° Commitment to provide, at least ten days before departure, local contact details and, for minors traveling abroad, a direct contact number;
Article R.211-7 to R.211-13
These articles govern contract transfer, price revision, modification or cancellation before and after departure, and the seller’s obligations to provide replacement services or refunds where applicable.
SPECIAL TERMS OF SALE
1. Travel Proposals, Quotations, and Pricing
1.1. You may contact us by phone or through our website (01 49 30 12 39 or www.explorateurspolaires.com). We offer personalized consultations at your location for which a fee of €60 applies, deductible from the total cost of your confirmed trip.
1.2. Our proposals include a travel program and terms, sent by email or mail. All trips are subject to availability.
1.3. Accurate personal information must be provided. We cannot be held responsible for errors in names, addresses, or contact details.
1.4. Prices are in euros, including all taxes, based on current economic conditions. Once signed, prices are final. Price adjustments may occur only due to:Transport cost variations, including fuel;Changes in applicable taxes or fees;Currency fluctuations affecting the cost.
Any changes will be communicated at least 30 days before departure.
1.5. If one or more travelers cancel, the trip may continue if remaining participants cover additional costs. Refusal will be treated as a cancellation under Article 6 fees.
2. Registration and Payment
2.1. Registration is final upon receipt of a completed, signed registration form. No withdrawal period applies under Article L.121-20-4 of the Consumer Code for online travel bookings.
2.2. For bookings more than 35 days before departure, a 35% deposit is required. For bookings within 35 days, full payment is due. Insurance premiums must be paid with the deposit.
2.3. Payment methods: credit card (CB, Visa, Mastercard), check payable to Les Explorateurs Polaires (more than 15 days before departure), or cash within legal limits.
2.4. Special cases:
• Additional deposits may be required for immediate airline ticket issuance, high seasons, or advance payment services.
• Bookings within 10 days of departure incur €50 “urgent processing” fees.
• Checks are not accepted for payments less than 15 days before departure.
2.5. Final payment is due no later than 30 days before departure. Late payment may be treated as cancellation under Article 6.
3. Travel Information and Formalities
3.1. Information is provided for French nationals. Non-French travelers must verify visa, administrative, and health requirements. The client is responsible for complying with regulations. Missing documents may result in denied boarding with no refund.
3.2. Safety information is available via the French Ministry of Foreign Affairs (www.diplomatie.fr), updated until departure. Some destinations may require signed acknowledgment forms.
4. Visa Requirements
4.1. Some countries require a visa. We can assist French passport holders. Passports must be submitted 40 days before departure.
4.2. Visa, consular, and shipping fees are listed in the quotation.
4.3. Urgent visa requests cannot be processed, though courier services may be recommended.
5. Client-requested Modifications
5.1. Before departure: modifications after registration but before ticket issuance incur €50 per file. Changes to tickets are treated as cancellations and rebookings under Article 6.
5.2. On-site modifications are subject to local provider terms. Additional costs must be paid locally; no refunds for unused services.
6. Cancellation Terms and Fees
Notification must be by hand delivery or registered mail. Cancellation fees are based on the issuance date:
More than 31 days: 35% of the trip cost
• 30–15 days: 50%
• 14–7 days: 75%
• 6 days to departure: 100%Partial cancellations are calculated based on unused individual services plus shared costs. Special conditions may apply for certain services or high seasons.
7. Air Transport
7.1. All airlines used from France are authorized to operate.
7.2. Airlines may modify schedules, routes, or airports without notice. Delays, cancellations, strikes, or other events outside Les Explorateurs Polaires’ control do not justify fee-free cancellations or compensation.
7.3. Travelers arranging their own pre- and post-transport should use refundable or changeable tickets and allow sufficient transfer time. Force majeure or traveler-induced changes are not reimbursable.
8. Insurance
Insurance options are available at registration. Complete terms, including exclusions and obligations, will be provided.
